GOVERNANCE PEOPLE LIMITED – ELEARNING TERMS OF BUSINESS AND PRIVACY POLICY

1 – Terms of use of the Governance People e-learning Modules

1.1 Duration of Access to the e-learning Modules

Unless otherwise expressly specified by GOVERNANCE PEOPLE , the licence to use the elearning courses accessible on our elearning platform is granted for :

– a duration of 6 (six) months starting from the delivery of the login giving access to the elearning modules as specified in the above article 2.

1.2 Scope of Users

Save express particular terms to the contrary covering, inter alia, the case of affiliated companies within a group of companies, the licence to use the elearning courses is granted solely to the Client having executed the order form.

1.3 Personal Licence to Use

The login and the password to the elearning platform, must be strictly privileged and confidential information of the utmost sensitivity, under the exclusive responsibility of the Client. They may therefore not be sold, redistributed or shared.

The Client hereby guarantees to GOVERNANCE PEOPLE the due performance of this clause by any User and shall be responsible for any fraudulent or abusive use of the access codes. The Client shall inform immediately GOVERNANCE PEOPLE of any loss or theft of the access codes.

In case of violation of the inalienability clause or in case where a sharing of the access codes would be evidenced, GOVERNANCE PEOPLE reserves the right to discontinue the service, without any indemnity nor prior notice.

2. Non-conformity or technical failures of the elearning Modules

“Technical failures” means any bug, error, defect, incident or non-conformity of the elearning courses with its/their related documentation.

“Non-conformity” means a failure of the elearning courses content to meet the requirements of the order form.

It is hereby acknowledge that GOVERNANCE PEOPLE shall not guarantee that the elearning courses will work without any interruption or without any error.

The Client shall provide all supporting evidence pertaining to the alleged defects.

However, GOVERNANCE PEOPLE shall not be held liable, in any way whatsoever :

– For any technical failure or modification of the equipment of the Client and for any wrongful or inappropriate use of the elearning courses by the users,

– For any technical failure link to software or product not provided by GOVERNANCE PEOPLE

– In case of any act of God or force majeure.

3. Email Support

GOVERNANCE PEOPLE will provide email support to the representative appointed by the Client, between 9:00 a.m. and 6:00 p.m. every business day. The email address for support purposes is support@login2elearn.com

4. Intellectual Property

In consideration for the payment of the price, GOVERNANCE PEOPLE grants to the Client a personal, non-transferable and non-exclusive licence to use the selected elearning modules for a duration limited to 6 (six) months.

Where the Client has provided GOVERNANCE PEOPLE with confidential, non public or proprietary content as part of the development of a custom or bespoke elearning course, GOVERNANCE PEOPLE recognises the intellectual property of the Client and will not reproduce such information without the express authorisation of the Client.

Any reproduction, representation, modification, publication, transmission, denaturation, in whole or in part, of the training session(s), are strictly forbidden, whatever the process or the medium used.

5. Confidentiality of User Data

GOVERNANCE PEOPLE understands the confidentiality of Client user data (employee names, email addresses and course completion data) and will ensure that such data is handled with the upmost due care as detailed in our Privacy Policy.

6. Marketing Rights

GOVERNANCE PEOPLE prides itself on providing quality services to a growing list of clients.  In order to support our marketing programme, the Client grants Governance People the right to use its logo in marketing material and on our websites.

7. Non Disclosure

The prices quoted in this document may contain volume discounts specific to your organisation that are commercially sensitive and subject to non-disclosure to third parties.  In accepting these terms you agree to treat pricing data with the upmost confidentiality.

8. Acceptance of these Terms

By placing an order you are expressly accepting these Terms of Business.

Our Privacy Policy

elearn.lu  treats the privacy of our visitors and users with the highest importance. This policy details the measures that we take to preserve and safeguard your privacy when you visit our website or communicate with our personnel. It also demonstrates how we may process data in accordance with the EU General Data Protection Regulation (“GDPR”).

This Privacy Policy may be updated from time to time.

2) Information Collection

We call data that identifies or could reasonably be used to identify you as an individual ‘Personal Data’. This includes information about you that you give us by filling on forms on this site, registering or by corresponding with us by phone, live web chat, email or otherwise. This information may include your full name, job title and contact details including your email address and telephone number.

If you complete a course on our web based platform (learning management system) we may also collect data about your progress in the course, the answers you provide to questions, and the score you achieve.  If you provide a rating for a course, you may optionally include your name and email address.

We do not collect or process any special categories of Personal Data.

3) Your Information and how we use it

We collect your data, including Personal Data, for certain legitimate business interests of ours. Processing under this basis may occur in the following circumstances:

  • When you make a request for further information on our website, either through a demo form, live web chat, contact form or similar transmission, we will use the data you provide to fulfil your request for information. We will also store this information on our database and use it to follow up with you, either by telephone or through an electronic communication.
  • When you register on our website, we will use the data provided to give you access to resources on the website.
  • When you subscribe to our newsletter, your email address will be stored with our third party processor, MailChimp, and we will use this to fulfil your subscription request.
  • When you interact with our website, we use Google Analytics to better understand your journey and help us provide improvements. Google Analytics may record your geographical location, device, internet browser and operating system, none of which would be classified as Personal Data.
  • Where you have provided us with your details, we may contact you to notify you of changes to our services.

When you register on our website, you are also given the opportunity to provide us with your consent. If you choose to do this, then we will use the Personal Data provided with your registration to let you know about our products and services which we think you will find interesting. You will be able to access resources on the website and will be sent relevant email notifications based on your interests. We may also contact you by telephone.

You can subsequently withdraw your consent at any time by contacting us, or following the ‘unsubscribe’ link that is provided in emails from Governance People.

Any information that we process, including Personal Data, will be stored on a secure server. We will not retain your Personal Data for longer than is necessary for the processing. Where you have registered and provided your consent to receive communications from us, then we will retain your Personal Data for this purpose until your consent is withdrawn.

4) Where will Your Information be Shared?

Governance People Limited will share your data to ensure smooth processing of your order and learning experience.  Governance People Limited is the Data Controller.

We use third party processors to assist us in storing your data safely and securely while interacting with our website. These third parties are carefully screened so we can ensure that there are adequate controls in place and, where relevant, that such third parties are GDPR compliant. Additionally, where this would result in the transfer of Personal Data outside the EEA, we have confirmed that there are appropriate transfer mechanisms in place.

Our third party processors include:

  • Google Analytics (no personal data processed)
  • Microsoft Office 365
  • Xero
  • MailChimp

We may change our third party processors from time to time.  This policy will be updated to reflect any changes.

If the course that you purchase is a product from a third-party provider (i.e. not a Governance People branded course), the data held within our Learning Management System may be shared with that provider when you have made a purchase or once you start accessing the course.

5) Your Rights

Under the EU General Data Protection Regulation, you possess a number of rights in relation to your Personal Data. These rights include (i) the right to be informed; (ii) the right of access; (iii) the right to rectification; (iv) the right to erasure; (v) the right to restrict processing; (vi) the right to data portability; (vii) the right to object; and (viii) rights in relation to automated decision making and profiling. Where you have provided us with consent, you have the right to withdraw this consent at any time. To reiterate, you can do this at any time by contacting us directly or following the ‘unsubscribe’ link provided in any electronic communications you receive from us.

You also have the right to complain to a supervisory authority where you feel that our processing of your Personal Data has infringed your rights. The supervisory authority in the Isle of Man is the Information Commissioner.

6) Accessing your Information

If you wish to exercise your right of access, then you may make a subject access request by contacting us as per the below. In most cases, we will not charge you a fee and will respond within one month. Fees may be charged for repeated or vexatious requests and we may take two months to provide all information in response to particularly complex requests. We will let you know if this is the case.

7) Cookies

Our site uses cookies to distinguish you from other users. This helps us to provide you with a good experience when you browse our site.

9) Cancellation Policy

Cancellation Prior to Receiving Course Login Information
Full refund is provided if cancellation request is made by email prior to your order being processed. Cancellations must be requested by emailing support@login2elearn.com.

Cancellation After Receiving Course Login Information
Cancellation requests need to be made within 48 hours of the issuance of course login information for a full refund. No refund will be provided after this time period or if login information has been used to access our elearning platform. Cancellations must be made by emailing support@login2elearn.com.

Extensions
Course extensions will not be granted. Students have access to a course for 180 days only.
